1. Introduction

Welcome to Hesed Journeys (K) Limited (“Hesed Journeys”, “we”, “our”, or “us”).

These Terms and Conditions govern your access to and use of the Hesed Journeys website, mobile applications, and transportation services. By registering for an account or using our platform, you agree to be bound by these Terms.

If you do not agree with these Terms, you should not use our services.

2. Our Services

Hesed Journeys provides a technology platform that connects passengers (“Riders”) with independent drivers (“Drivers”) for transportation services.

Hesed Journeys does not own, operate, or control the vehicles used by Drivers and is not a transportation carrier. Transportation services are provided by independent Drivers using the platform.

3. Eligibility

To use the platform, you must:

Be at least 18 years old.
Provide accurate and complete registration information.
Maintain the security of your account credentials.
Comply with all applicable laws and regulations.

Drivers must additionally provide valid documentation including identification, driving licenses, vehicle registration, insurance, and any other information required by Hesed Journeys.

4. User Accounts

Users are responsible for:

Maintaining accurate account information.
Keeping login credentials confidential.
All activities conducted through their accounts.

Hesed Journeys reserves the right to suspend or terminate accounts that provide false information or violate these Terms.

5. Ride Requests and Acceptance

When a Rider requests transportation through the platform:

The request is transmitted to nearby available Drivers.
Drivers may choose to accept or decline ride requests.
Ride availability is not guaranteed.
Estimated arrival times, fares, and routes are estimates and may vary.

6. Pricing and Payments

Fares are calculated based on factors including:

Distance travelled
Duration of the trip
Applicable service charges
Waiting time charges
Promotional discounts or offers

By requesting a ride, you authorize Hesed Journeys to process payment through your selected payment method.

Failure to make payment may result in suspension of platform access.

7. Cancellations

Rider Cancellations

Riders may cancel ride requests. Cancellation fees may apply where a Driver has already accepted the ride or traveled toward the pickup location.

Driver Cancellations

Drivers may cancel rides under reasonable circumstances. Repeated cancellations may result in account review or suspension.

8. User Conduct

Users must not:

Use the platform for unlawful purposes.
Harass, threaten, abuse, or discriminate against other users.
Provide false information.
Damage vehicles or property.
Engage in fraudulent activities.
Attempt to interfere with the operation of the platform.

Any violation may result in immediate suspension or permanent termination of access.

9. Driver Responsibilities

Drivers are responsible for:

Maintaining valid licenses and permits.
Ensuring vehicles are roadworthy and insured.
Complying with traffic laws and regulations.
Providing professional and safe transportation services.

Drivers remain independent service providers and are not employees of Hesed Journeys unless otherwise agreed in writing.

10. Safety and Location Services

The platform relies on location services to facilitate ride matching, navigation, trip tracking, and safety features.

Users acknowledge and consent to the collection and use of location information as described in our Privacy Policy.

Disabling location services may affect the functionality of the platform.

11. Ratings and Feedback

Riders and Drivers may rate and provide feedback about one another.

Hesed Journeys reserves the right to investigate complaints and take appropriate action where user conduct fails to meet platform standards.

12. Intellectual Property

All trademarks, logos, software, content, designs, and technology associated with Hesed Journeys remain the property of Hesed Journeys (K) Limited or its licensors.

Users may not copy, modify, distribute, reverse-engineer, or exploit any part of the platform without written permission.

13. Limitation of Liability

To the fullest extent permitted by law:

Hesed Journeys provides the platform on an “as available” basis.
We do not guarantee uninterrupted or error-free service.
We are not liable for delays, traffic conditions, weather events, accidents, actions of third parties, or circumstances beyond our reasonable control.

Our liability shall be limited to the amount paid by the user for the specific ride giving rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless Hesed Journeys, its directors, employees, agents, and affiliates from any claims, liabilities, damages, losses, and expenses arising from:

Your use of the platform.
Violation of these Terms.
Violation of applicable laws.
Infringement of the rights of any third party.

15. Suspension and Termination

Hesed Journeys may suspend or terminate accounts at any time where:

These Terms are violated.
Fraudulent activity is suspected.
Safety concerns arise.
Required documentation becomes invalid.
Legal or regulatory obligations require such action.

16. Privacy

Your use of the platform is also governed by our Privacy Policy, which explains how personal information is collected, used, stored, and protected.

17. Changes to These Terms

We may update these Terms from time to time.

Updated versions will be posted on our website and applications. Continued use of the platform after changes become effective constitutes acceptance of the revised Terms.

18. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Kenya.

Any disputes arising from these Terms shall be subject to the jurisdiction of the courts of Kenya.
